The following terms and conditions (the “Terms and Conditions”) govern the APG Loyalty Program (the “Loyalty Program”) and the use of the APG digital applications (the “Apps”). Please read these loyalty program terms and conditions of participation in the APG loyalty program carefully. By participating in this program, you agree to be bound by the terms described herein and all terms incorporated by reference. If you do not agree to all of these terms, do not participate in this program.
1.1 “Car Wash” means a car wash (subject to availability) at an APG Gas Station Site.
1.2 “Customer Services” means the Loyalty Program customer services team, which can be contacted by emailing info@apg-lb.com or by calling +961 70 954 038 from Monday to Friday between 09:00AM and 05:00PM.
1.3 “Fuel” means APG Main grade fuels and Shell V-Power fuels, subject to availability at Participating Sites.
1.4 “Hot Drink” means a medium (or equivalent) sized coffee, tea or hot chocolate product (depending on availability) from the coffee concession operating at an APG Gas Station Site where a Reward is being redeemed.
1.5 “Membership Card” means the APG Loyalty Program membership card.
1.6 “Operator” means APG sarl, Boulevard General Emile Lahoud, Tarraf Building 2nd Floor, 1003, Chayyah, Baabda, Lebanon.
1.7 “Participating Site” means a APG service station at which the Member Benefits and Rewards of the Loyalty Program may be redeemed. A full list of participating sites is available at www.apg-lb.com (please note that this list is subject to change and may be amended at APG’s sole and absolute discretion) together, the “Participating Sites”.
1.8 “Privacy Policy” means the APG privacy policy.
1.9 “Promoter” or “APG” means APG sarl, Boulevard General Emile Lahoud, Tarraf Building 2nd Floor, 1003, Chayyah, Baabda, Lebanon.
1.10 “Qualifying Purchase” means a purchase made by a member, using the App or the Membership Card, of either: (i) an amount of fuel that is equal to or exceeding LBP 500,000.00 at a Participating Site; or (ii) a purchase of any other product available for sale at a Participating Site excluding Fuel, or any range of specific products in the excluded products list determined by APG. Independent purchases made at the same or a different Participating Site within 10 minutes of each other will be clustered together and treated as a single purchase, provided that each independent purchase is a Qualifying Purchase.
1.11 “Soft Drink” means a soft drink from a range to be determined by APG; and
1.12 “Website” means www.apg-lb.com.
2.1 The Terms and Conditions, in conjunction with the Privacy Policy are applicable to the Loyalty Program. Any participation in or use of the Loyalty Program, which includes any use of the Membership Card and/or the App, is considered as acceptance of both the Terms and Conditions and the Privacy Policy.
2.2 The Membership Card is issued by and remains the property of APG sarl. Any Membership Card must be returned to APG on request.
2.3 APG may at any time, and at its sole and absolute discretion:
2.4 Each member of the Loyalty Program must be resident in Lebanon and aged 17 years or over (to be assessed on the day that the member joins the Loyalty Program).
2.5 Loyalty Program membership is not transferable, cannot be copied and can only be used by the member who is named and registered on the Membership Card or App.
2.6 APG may withdraw, cancel or decline to issue any Loyalty Program account, Membership Card, discount and/or any other accrued Reward in whatever form, and/or remove a member from the Loyalty Program at any time where APG has a reasonable belief of any:
2.7 The Membership Card is not a credit, debit or cheque guarantee card. APG will only share members’ details with the Operator and businesses that process or take part in the Loyalty Program in accordance with the Privacy Policy.
2.8 The Terms and Conditions do not confer any enforceable rights on a person who is not party to the Terms and Conditions.
2.9 The redemption of Member Benefits and Rewards is available at Participating Sites only and is subject to availability. The Rewards are provided by APG on the basis of, and subject to, the terms and conditions applicable to each Reward as set out in the App and Website. In the event that a member has multiple rewards to redeem, APG can, at its sole discretion, determine which rewards will be redeemable first. In this regard, the reward which is redeemable first will be determined by what APG deems the reward most beneficial to the Member.
3.1 Customers may become an APG Loyalty Program member by registering their membership either at the company or via the App or the Website.
3.2 All registration details must be completed in full and must contain the proposed member’s name, gender, home address, province, mobile number and e-mail address.
3.3 Members must keep APG informed of any changes to their registration details by ensuring that the details are up to date on their Loyalty Program account.
3.4 To make any changes to personal details, members must log in to their Loyalty Program account via the App or Website, or contact Customer Services.
4.1 Members can cancel their membership to the Loyalty Program at any time by contacting Customer Services. The obsolete data relating to that member will be deleted in accordance with the Privacy Policy.
4.2 By leaving the Loyalty Program members forfeit the right to any Reward(s) already accrued or issued.
4.3 Should a APG Loyalty Program membership be inactive for a period of 2 full calendar years (January to December), then such an account will be automatically deleted and any such member wishing to re-join the Loyalty Program will have to re-register and create a new membership.
5.1 The Loyalty Program benefits comprise of APG Loyalty Program Member benefits (“Member Benefits”) and Rewards.
5.2 Member Benefits are available to all members at all times for the entire duration of their Loyalty Program membership. They comprise of discounts (made available in digital form through the App and the Website) on selected: (i) Hot Drinks; (ii) Car Wash services; (iii) Engine oils; and/or (v) other products that APG, at its absolute discretion, may determine.
5.3 Promotional vouchers can only be redeemed before the claiming process is complete. It is not possible to apply vouchers retrospectively. Promotional vouchers cannot be transferred to third parties. Unless we have agreed otherwise, it is not possible to combine multiple promotional vouchers.
5.4 Rewards comprise of the following types of rewards (together the “Rewards”) that may be issued to members and made available in digital form through the App and the Website:
6.1 Personal data supplied by members (whether existing or new) will be processed in accordance with applicable data protection laws and the Privacy Policy.
6.2 APG may use the personal data members supply for the following purposes:
6.3 APG will not disclose personal data to third parties without member consent, except for the purposes of fulfilling member benefits and rewards or where required by law.
7.1 Neither APG nor its agents shall be liable under, or in connection with, the Terms and Conditions, the Loyalty Program or the use or redemption of any Reward for any indirect, special or consequential cost, expense, loss or damage even if such cost, expense, loss or damage was reasonably foreseeable or might reasonably have been contemplated by the member, APG or its agents, and whether arising from breach of contract, tort, negligence, breach of statutory duty or otherwise.
7.2 APG may amend or vary the Terms and Conditions at any time, at its sole and absolute discretion.
7.3 Any changes to the Terms and Conditions will be posted at www.apg-lb.com/terms.
7.4 APG’s decision is final in every situation (including any not expressly mentioned in the Terms and Conditions).
7.5 APG and the Operator reserve the right to investigate any activity they believe to be of a fraudulent nature and to disqualify any members that they believe are carrying out fraudulent activity or otherwise seeking to circumvent the Terms and Conditions.
7.6 APG accepts no liability for lost, damaged or corrupted data; expired rewards or incomplete or incorrect use of the App whether due to omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise.
8.1 APG Loyalty Program Privacy Policy (which forms part of the Terms and Conditions) sets out how we use your data in relation to the Loyalty Program. By participating in the Loyalty Program, you acknowledge that you have read, understood and accepted the Privacy Policy.
8.2 For any further matters regarding the processing of your personal data, please consult the Shell Privacy Policy available at www.apg-lb.com/privacy.
9.1 If you choose or are provided with a username, password or any other piece of information as part of APG’s security procedures, you must treat such information as confidential and you must not disclose it to any third party nor allow any unauthorized person access to the App under your username and/or password. You are responsible for any actions that take place while using your App account or while using the App via your Device and APG is not responsible for any loss that results from the unauthorized use of your username and/or password, with or without your knowledge.
9.2 Be aware that the use of some of the functionalities of the service requires access to the internet and your carrier's normal rates apply. The service contains services and features that are available to Devices having an internet connection and able to download, install and use the App.
Each of the Clauses or sub-clauses of these Terms and Conditions of Use operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining Clauses or sub-clauses will remain in full force and effect.
APG may, by any means including notification on the website, app, or by email, or by means of a notice on our homepage or in writing: vary, add to or delete any of these Terms and Conditions (including without limitation any terms contained in written correspondence and the Privacy Policy) or impose new terms and conditions for any other card scheme or online service which is similar to the current card scheme or online service (whether or not such new scheme is operated by APG or by a third party on behalf of APG). The use of any Card after notification of any variation to these Terms and Conditions or the imposition of new terms and conditions shall be deemed to be acceptance of the varied or new terms and conditions by the Customer.
12.1 This Program and these Terms will be governed by and construed under the substantive laws of Lebanon, as if they were a contract wholly entered into and wholly performed within Lebanon and without reference to conflict-of-laws considerations.
12.2 Any dispute relating in any way to this program, these terms, your program membership, or the relationship between the parties shall be submitted to confidential arbitration in Lebanon and you agree to submit yourself to the jurisdiction and proceedings thereof. Arbitration means that a single arbitrator will decide the claim, and you will not have the right to sue in court or to have a judge or jury decide your claim. Your rights to prehearing exchange of information and appeals may also be limited in arbitration. It is further agreed that any dispute over the scope of this arbitration provision and any dispute as to whether a claim is arbitral shall be submitted to the arbitrator for decision. Notwithstanding the foregoing, to the extent you have in any manner violated or threatened to violate our intellectual property rights or the intellectual property rights of our affiliates, partners or licensors or otherwise have a cause of action in equity, we may seek injunctive or other appropriate relief in any court of competent jurisdiction and you consent to jurisdiction and venue in any such court for such purposes. Arbitration under these terms shall be conducted under the consumer-related disputes supplementary rules then prevailing with the Lebanese arbitration organism. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
12.3 You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually, and (i) no arbitration or proceeding shall be joined with any other; (ii) there is no right or authority for any dispute to be arbitrated or resolved on a class action-basis or to utilize class action procedures; and (iii) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons. You agree that you may bring claims against us only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
13.1 By enrolling in the APG Loyalty Program, you will be automatically subscribed to receive and consent to receiving (i) Program related emails, including Program marketing emails and (ii) Pattern Online emails, including marketing emails.
13.2 You may opt-out of receiving APG Loyalty Program or APG marketing emails at any time, but operational emails will still be sent to you as they relate to your membership in the APG Loyalty Program, and you consent to their receipt. Examples of these include, but are not limited to, a redemption confirmation email, a profile update email, or other communications that relate to your account. If you terminate your APG Loyalty Program membership, you will no longer receive APG Loyalty Program-related communications.
